1. Acceptance of Terms

By accessing or using the Services provided by Mixel Studio, Inc., you agree to these Terms of Service (“Terms”). If you do not agree, you may not use the Services.

2. Description of Service

Mixel provides a platform for creating, authoring, and operating real-time, multi-device immersive experiences, including browser-based editors, XR clients, and session orchestration services. The Services may evolve over time, and features may be added, modified, or removed.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

4. User Content

You retain ownership of content you upload or create using the Services. By using the Services, you grant Mixel Studio, Inc. a limited, non-exclusive license to host, process, and transmit such content solely for the purpose of operating and improving the platform. You represent that you have the rights necessary to use and upload your content.

5. Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, or deceptive purposes
  • Attempt to interfere with system integrity, security, or performance
  • Reverse engineer or misuse platform infrastructure
  • Upload content that infringes intellectual property or privacy rights

We reserve the right to suspend or terminate access for violations.

6. XR and Real-Time Limitations

The Services involve real-time networking, device coordination, and third-party hardware. As a result:

  • Performance may vary due to network, hardware, or environmental conditions
  • Temporary interruptions or degraded experiences may occur
  • The Services are provided “as is” and “as available”

We do not guarantee uninterrupted or error-free operation.

7. Intellectual Property

The Services, including software, designs, and documentation, are owned by Mixel Studio, Inc. and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, or distribute platform components without written permission.

8. Disclaimer

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

To the extent permitted by law, Mixel shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.

10. Termination

We may suspend or terminate access to the Services at our discretion, particularly for violations of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
